Competition Regulations: 

"zondacrypto - win a gold Macbook Air!". 

 

§ 1 General provisions

 

1. These terms and conditions (hereinafter: "Terms and Conditions") define the rules of the "zondacrypto - win a gold Macbook Air!" contest. (hereinafter: "Contest").

2. The organizer of the Contest is BB Trade Estonia OÜ, headquartered in Tallinn, address: Harju maakond, Tallinn, Lasnamäe linnaosa, Tähesaju tee 9, 1391 Estonia (office number 10), registered in the Register of Entrepreneurs under the number 14814864, (hereinafter: "Organizer") operating an online service (https://zondacrypto.com/) through which it provides services in the form of running a cryptocurrency exchange (hereinafter: "Platform").

3. The tasks of the Competition Organizer are to supervise the course of the Competition on an ongoing basis, including, in particular, whether there is a threat of a violation of the Competition rules established by these Regulations in connection with the course of the Competition. 

4. The Organizer also uses in these Contest Regulations definitions consistent with those contained in the regulations available at https://zondacrypto.com/pl/legal/zonda-exchange and to which it hereby refers in this regard.

5. The Contest is conducted through the Organizer's social media on the platform "tik tok" - profile run under the name "zondacrypto": https://www.tiktok.com/@zondacrypto (hereinafter: "Social Media"). Links to the Contest will also be provided informatively on zondacrypto's social media profiles, including but not limited to: https://twitter.com/zondacrypto & https://twitter.com/zondacryptopl), and instagram.   

6. The Contest is directed to users of the aforementioned social media. The purpose of the Contest is to reward Participants for actively following the Organizer's Social Media and to engage Participants through active participation during the Contest Period.

7. The Organizer emphasizes that the Contest is not created, administered or sponsored by the aforementioned social media.

8. The Contest organizer is the sole founder of the Contest prize.

9. The contest is not a cash lottery, a sweepstakes, a promotional lottery, or any other game of chance or betting.

10. All information about the Contest available in advertising materials is for informational purposes only.

 

§ 2 Participation in the Contest

 

1. The contest is intended only for individuals - recipients of Social Media, who are adults (who are 18 years of age or older) and who have a residence in countries/regions supported by the zondacrypto cryptocurrency exchange operated by the Organizer (countries/regions not accepted are indicated on https://zondacrypto.com/pl/kraje-nieakceptowane).

2. Only a natural person who has an active profile/account on the "Instagram" platform in accordance with the rules of this portal can become a participant in the Contest (hereinafter: "Participant").

3. The Contest can only be participated in personally, and therefore it is unacceptable to take part in the Contest on behalf of third parties. The Organizer reserves the right to verify the Participants of the Contest and, in the event of reasonable doubts regarding the fulfillment of the above mentioned conditions, to possibly refuse the Participant to win the Contest on this basis. 

4. Only self-reported answers, the author of which is the applicant (Contest Participant), can be submitted to the Contest.

5. Employees, members of the authorities and representatives of the Organizer and other entities directly involved in preparing and conducting the Competition, as well as persons cooperating with the above-mentioned entities on a permanent basis on a basis other than an employment relationship, and members of their immediate families, i.e. ascendants, descendants, siblings, spouses, parents of spouses and persons in an adoption relationship with them, cannot participate in the Competition.

6. The condition to participate in the Contest is acceptance of the content of these Regulations and willingness to participate in the Contest by making a Contest entry in the form of fulfilling all Contest requirements together on the aforementioned Organizer's social media profiles. 

7. A participant who enters the Contest in accordance with the preceding paragraphs is obliged to familiarize himself with the provisions of the Regulations. Entering the Contest is tantamount to acceptance of the content of these Regulations.

8. Entering the Contest is completely voluntary and free of charge. 

9. Participation in the Contest and the related provision of personal data is completely voluntary, based on the Participant's consent - in accordance with § 12. paragraph 2. a) of these Regulations. 

10. In the event of winning the Prize referred to in § 5. below, the Participant further agrees to publish his/her name or profile name used in social media, as part of the post/announcement created by the Organizer regarding the end of the Contest and the selection of the winners, on the Organizer's profiles in the aforementioned social networks. 

 

§ 3 Duration of the Competition

 

1. The Contest begins on December 3, 2024 when it is announced on the Organizer's Social Media and will continue until December 20, 2024 at 8:00 p.m. CET (hereinafter: "Contest Duration").

2. Settlement of the Contest will take place within 24 hours after the end of the Contest, with the announcement of the Winners scheduled for December 21, 2024 at 14:00 am CET. The Winner of the Contest will be notified of his/her win on this date by the Organizer's publication of the winning post informing on the particular social media, which is the venue of the Contest, through which the Participant submitted his/her participation, or in the form of a private message from the Organizer.

3. The prize will be sent to the Winner on the condition that the Winner makes contact with the Organizer in a private message and that the Winner indicates all data allowing the Contest prize in kind to be sent. In order for the Prize to be awarded to the Winner, it is required that the Winner make immediate contact with the Organizer within 10 hours from the publication of the post about the results of the Contest, and then immediately provide, in a private message to the Organizer, all contact details indicated in § 6. paragraph 2, § 7. paragraph 2, or § 8. paragraph 2 of the Regulations (depending on the type of Prize).

 

§ 4 Rules of the Competition

 

1. The Contest Task consists in the Participant's fulfillment of the following Contest Tasks together (hereinafter: "Contest Tasks"):

   1. observing the Organizer's profile on the "Tik tok" platform: https://www.tiktok.com/@zondacrypto

   2. providing an answer in a comment under the contest post to the question "What do you choose bull market or bull market ?". Only the answer posted under the contest post placed on the Organizer's Profile on the "Tik tok" platform: (https://www.tiktok.com/@zondacrypto) will be taken into account when selecting the Winners.

2. The competition is open to the public.

3. A participant in the Contest may be both a person who already has a fully functional account on the Organizer's Platform, i.e. after registration, provision of user identification data and successful verification by the Organizer (KYC), and a person who does not have an account on the Organizer's Platform, subject to §8.1 of the Regulations.

4. Completion of any of the Contest Tasks after the expiration of the Contest Period will result in such Contest entry not being considered by the Organizer.

5. The Participant's completion of only some of the tasks or posting the contest answer under the contest post on a profile other than the Organizer's Profile specified in § 4. paragraph 1. b. of the Regulations. Regulations, may entail the Organizer's recognition of the provided answer as incorrect or incomplete. 

6. The Contest responses will be evaluated by the Contest Committee (hereinafter referred to as the "Committee"), consisting of representatives of the Organizer and persons designated by the Organizer, as specified in § 10. of the Regulations. 

7. At the end of the Contest, the Commission will select from among the Participants eight (8) winners who have collectively completed all the Contest Tasks specified in § 4. paragraph 1 of the Regulations, and whose answers to the Contest question are considered by the Commission to be the best (hereinafter referred to as: "Winners", and individually as: "Winner"). 

8. In the Contest, the Winners, depending on the place taken, will be awarded prizes described in § 5. of the Regulations (hereinafter: "Prize").

9. The Committee will award, taking into account all correct Contest Responses, eight persons, based on the evaluation of all Contest Responses meeting the conditions of these Regulations, taking into account such criteria as: ingenuity, creativity, originality, the Participant's knowledge of the cryptocurrency market and the zondacrypto Platform, the form of presentation of his/her interest in cryptocurrencies and the zondacrypto Platform, the way in which the Participant's response was formulated, presentation of his/her point of view on the cryptocurrency market and the zondacrypto Platform.

10. The answers of the Participants who, in the opinion of the Contest Committee, provided the most interesting and creative answers to the contest question (winning answers) will win. The decision in this regard will rest solely with the Contest Committee considering the given entries.  

11. When selecting the Winners, the Committee shall at the same time decide on the awarding of a given Prize in the Contest to a given Winner, following the criteria indicated in the preceding sentence and assessing whether he/she meets the conditions set forth in § 2. and § 4. of the Regulations. 

12. The winner of the Contest will be announced by posting the winning post on the Organizer's social media mentioned above, indicating the name or username of the Participant who provided the correct answer. When announcing the results, the Organizer will ask the Winner to contact him/her in a private message within the social network where the announcement of the Contest results was posted. Once contact is made, the Organizer will provide further instructions in order to determine all the data necessary to send the Winner the Prize and to enable the Winner to use it properly. 

13. The Winner is obliged to make immediate contact with the Organizer in a private message on the social media on which the announcement of the results of the Contest was posted, no later than 10 hours after the announcement of the results of the Contest, under pain of complete forfeiture of the right to the Prize. Failure to contact the Organizer within this timeframe, will be equivalent to the possibility of selecting another Winner, while this is reserved as a right and not an obligation of the Organizer (due to organizational capabilities, it may not be possible to provide another Winner with participation in the Prize at a later date). 

14. The Organizer reserves the right to exclude from participation in the Contest or deprive of the right to the Prize Participants whose actions violate the law, good morals or the Regulations, in particular Participants who:

• do not act personally, but through third parties;

• use different accounts on the Organizer's platform to appear in on behalf of/submit the same Participant;

• if third-party claims have been made in relation to their Contest Answer.

15. In order to clarify any doubts related to the Participant's activity in the Contest, the Organizer may contact the Participant using the means of communication provided by the Participant; during such contact, the Organizer may expect the Participant to provide detailed information regarding his/her participation in the Contest.

16. Participant, applying for participation in the Contest, declares that the Contest Answer submitted by him does not contain content that violates the law or is inconsistent with good morals, in particular does not violate the rights of third parties, does not incite violence, intolerance, does not contain vulgarities or advertising content of third parties.

 

§ 5 Award

 

1. The following prizes will be awarded in the Contest, subject to § 5. paragraph 3 of the Regulations:

   1. For place I - Macbook Air M3 with the following specifications: Apple M3 processor, RAM 8 GB, SSD 256GB, Diagonal screen size 13.6", Screen resolution 2560 x 1664, USB4 Type-C connectors (with Thunderbolt™ 4) - 2 pcs, Headphone output/microphone input - 1 pc. MagSafe 3 - 1 pc.

The award specified in § 5. section 1. a. is hereinafter referred to as: "Award in kind".

 

2. The Organizer stipulates that the number of Prizes may be changed in favor of the Winners (by awarding additional prizes).

3. The Commission independently awards the Winners guided by its own discretion and the criteria specified in § 4. paragraph 9 of the Regulations.

4. Prize for first place in the number of pieces 1 (one) for each place taken. One Winner of the Contest is entitled to only one Prize. 

5. The Organizer does not cover additional costs related to the collection and use of the Prizes, such as travel, passage, cabs, flights, shipping, accommodation, meals and other incidental costs. These costs shall be borne entirely by the Winner and he/she shall not be entitled to reimbursement from the Organizer in this regard. The Organizer reserves the right to make different individual arrangements with the Winners, but such arrangements shall not be made to the detriment of other Winners of the Prize of the same type.

6. It is not possible to transfer the right to the Prize to third parties.

7. Prizes are not exchangeable for cash equivalent or other services that are included in the Organizer's offerings

8. It is possible to resign from the Prize. In the event that the Winner resigns from the Prize, the Organizer reserves the right to award the Prize to the next Participant designated by the Committee.

9. The Winner, as part of his/her use of the Prize, will be asked by the Organizer to prepare promotional materials regarding his/her participation in the aforementioned Contest (hereinafter: "Winner's Marketing Materials") as part of his/her participation in the Prize. In such case, the Winner may agree to publish the promotional materials prepared by the Winner on the Organizer's social media, thereby granting the Organizer a free and unlimited license to publish them as part of the promotion of such social media of the Organizer, and solely for this purpose.  

 

§ 6. in-kind awards

 

1. The In-Kind Prize will be sent to the Winner of the Contest immediately after it is received by the Organizer. The In-Kind Prize will be forwarded to the Winner via a postal operator or courier to the address indicated by the Winner in his/her private contact with the Organizer, in accordance with § 4. paragraphs 12 and 13 of the Regulations.

2. The Winner, in order to be able to receive the Prize in kind, is obliged to send in a private message to the Organizer, as indicated by the Organizer, all the data necessary to transfer the Prize to him/her, i.e.: 

   1. Name,

   2. email, 

   3. phone number,

   4. The address to which the Prize in Kind is to be delivered. 

In the event that the above information obligation is not fulfilled within the timeframe specified above, the Winner will lose the right to the Prize in Kind. In such case, the Organizer reserves the right to award the prize to the next Participant, selected by the Contest Committee. 

3. In the event that the Winner fails to provide the Organizer with data enabling the ordering of the shipment of the Prize in Kind due to the Participant, the Prize in Kind shall be forfeited and the Organizer shall be entitled to select a new Winner.

4. The Organizer is not responsible for incorrectly provided data for shipment of the In-Kind Prizes. In the event that a shipment addressed according to the details provided by the Winner is returned, the Prize in Kind is forfeited and remains at the disposal of the Organizer.

5. In-kind prizes are shipped only within the territory of the Republic of Poland. The Organizer reserves the right to make individual arrangements in this regard with the Winners.

6. In the event that the Winner resigns from the Prize in kind and fails to collect it, the Organizer reserves the right to award the Prize to the next Participant designated by the Committee.

 

§ 7 Liability of the Organizer

 

1. The Organizer is not responsible for the inability to realize the Prize of the Winner and to realize the Prize due to reasons beyond the Organizer's control, including the lack of positive verification of the Participant (KYC), providing incorrect contact information, as well as due to force majeure events. In such a case, the Winner will be informed of the aforementioned circumstances in a private message or will be asked to contact us in a comment under the contest post. 

2. The Organizer is not responsible for any fortuitous events that prevent Participants from taking part in the Contest.

3. The Organizer is not responsible for the inability to collect the Prize if the Participant fails to meet the deadline specified in § 4.13 of the Regulations.

4. The participant is solely responsible for the content of the contest answer provided, communicated to the Organizer on social media, and in this respect releases the Organizer from any liability to third parties whose rights have been violated by publishing the solution to the contest task on its portals or by using the solution in a manner inconsistent with these Regulations.

5. The Organizer is not responsible for the Winner's claims related to the expectations of the In-Kind Prizes. The Winner is entitled to make claims on his/her own behalf directly to the entities responsible for the creation of the In-Kind Prizes.

 

§ 10 Competition Commission

 

1. The proper conduct of the Competition will be supervised by a Commission appointed by the Organizer, consisting of two persons.

2. The tasks of the commission referred to in the preceding paragraph include, in particular:

   • Checking whether a given Participant meets all the conditions for participation in the Contest,

   • Determination of the Winners of the Competition,

   • Evaluation of the Contest Responses and awarding them with their respective competition places from place I (best evaluated) to place VIII.

   • Processing of Participant's complaints, in accordance with §11. of the Regulations. 

 

§ 11 Complaints

 

1. Complaints related to participation in the Contest, the Participant may submit electronically through the form available at: https://zondacrypto.com/pl/helpdesk/formularz-kontaktowy.

2. Complaints should be submitted immediately after the occurrence of an event that raises concerns of a Participant participating in the Contest, but no later than within 7 days from the end of the Contest (for complaints sent by registered mail, the postmark date is decisive).

3. The complaint should contain all the information specified in the regulations found on the zondacrypto platform, available at https://zondacrypto.com/pl/legal/zonda-exchange.

4. The complaint procedure is carried out in accordance with the procedure contained in the regulations indicated in paragraph 3 of this section. 

5. Complaints will be handled by the Organizer.

 

§ 12 Personal Data 

 

1. The administrator of the personal data is BB Trade Estonia OÜ with its registered office in Harju maakond, Tallinn, Lasnamäe linnaosa, Tähesaju tee 9, 1391 Estonia (office No. 10), a company under Estonian law, registered in the Register of Entrepreneurs under number: 14814864 (hereinafter: "Data Controller").

2. The Data Administrator processes personal data of Participants and Winners of the Contest on the basis of: 

   1. consent within the meaning of Article 6(1)(a) of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter: "RODO");

   2. Fulfillment of a legal obligation incumbent on the Data Controller within the meaning of Article 6(1)(c) of the DPA to fulfill the obligation to keep accounting documents;

   3. legitimate interest of the Data Controller in accordance with Article 6(1)(f) of the RODO, consisting, in particular, in responding to possible complaints, claims made as a result of this competition.

3. All data obtained by the Organizer of the Participants and the Contest Winner will be deleted or anonymized within 60 days, counting from the date of the end of the contest or the sending of the Prize to the Contest Winner. This does not apply to data processed in connection with the provision of services on the Organizer's Platform.

4. Data of Participants and Winners of the Contest will be deleted or anonymized in accordance with the preceding paragraph - with the exception of data that will be necessary to comply with legal obligations incumbent on the Data Controller and in order to fulfill the Data Controller's legitimate interest - necessary for the consideration of complaints or other form of claims submitted by Customers, Participants or Winners of the Contest, as well as for the purposes of possible judicial or administrative proceedings.

5. The data is protected by technical and organizational measures to ensure an adequate level of protection, in accordance with applicable regulations.

6. The Data Administrator shall process only the personal data provided by the Participant or Winner of the Contest. The personal data of the Contest Participants/Winners are not subject to automated decision-making for the purpose of the Contest. 

7. For the purposes of the Contest, personal data will be shared with companies affiliated by capital and personal links with the Data Administrator, i.e. - Orion Software sp. z o. o. and Expofer Servis House s. r. o. 

8. Participants in the competition are entitled to:

   1. to request from the Data Controller access to, rectification, erasure or restriction of processing of personal data concerning the data subject, and the right to object to processing, as well as the right to data portability;

   2. file a complaint with the supervisory authority - Estonian Data Protection Inspectorate, 39 Tatari, 10134 Tallinn, Estonia, if the Participant believes that his/her personal data is being processed unlawfully; 

9. All requests, questions and demands related to Data processing should be addressed to the Data Protection Officer appointed by the Administrator: gdpr@zondacrypto.com.

 

§ 13 Intellectual property rights

 

By participating in the Contest, the Participant simultaneously declares that he/she is the sole creator of the Winner's Marketing Materials and that he/she has full personal and property copyrights to the same.

 

§ 14 Final Provisions

 

1. These Regulations are the only document setting out the detailed rules of the Competition.

2. The Organizer is entitled to change the content of the Regulations, both in part and in whole, at any time. Participants will be informed of any planned changes to the Terms and Conditions through an adequate communication channel, such as Social Media.

3. If the participant does not accept the changes to the Regulations, he/she should withdraw from participation in the Contest.

4. Entering the Competition after the Rules have been amended shall be deemed acceptance of the new Rules.

5. The Regulations are available for the duration of the Contest on the Organizer's website (zondacrypto.com) and at the Organizer's headquarters.

6. Any doubts regarding the terms, conditions and deadline of the Contest, the provisions of its Regulations and its interpretation shall be resolved by the Organizer. Such resolution of the Organizer does not deprive the complainant of the right to pursue claims under the rules of law.  

7. All information about the Competition can be obtained by contacting zondacrypto at e-mail: support@zondacrypto.com.

8. In matters not regulated by these Regulations, the provisions of the Organizer's Regulations and generally applicable laws shall apply.

9. In case of conflict between the provisions of the Regulations and the provisions of the Regulations of the Organizer, the provisions of these Regulations shall apply.
