§ 4

Contest Tasks and Ranking Points

  1. The Contest Tasks that must be completed in order to participate in the Contest (hereinafter individually and collectively: "Contest Task") and to earn as many Ranking Points as possible, allowing Participants to be assigned specific places in the final Ranking of Winners, consist of performing all of the following Tasks (completion of only one of the Tasks indicated in points A and B below will not be considered as effective participation in the Contest):

  1. the Participant undertaking, during the duration of the Contest, resulting from § 3(1) above, specific activities on the ZND Platform as part of the Loyalty Program, for which ZND Loyalty Points (hereinafter referred to as "ZND Loyalty Points") will be awarded. The activities that can be performed as part of this Contest Task and for which ZND Loyalty Points will be awarded, as well as the Regulations for awarding such Loyalty Points under the ZND Loyalty Program, are set out in the general documents available on the ZND Platform in the form of:

The Organizer reserves that only ZND Loyalty Points accumulated during the Contest (in accordance with § 3(1) of the Regulations) will be taken into account in the Contest, and therefore each Participant will have 0 (zero) points counting towards the Ranking Points in the Contest at the time of its start (even if their ZND Loyalty Points balance in their ZND Account before the start of the Contest is actually higher). For this purpose, the Organizer will keep a separate summary of ZND Loyalty Points accumulated by Participants only during the Contest and, consequently, counting towards the Ranking Points at the end of the Contest.

  1. At the same time, the Participant shall undertake specific activities via the Application, including taking into account § 5(6) of the Regulations (activities undertaken outside the Application shall not be considered as completion of a Contest Task). Each of the individual Contest Tasks is assigned a specific number of Points (hereinafter: "Application Points"), which will then determine the multiplier that a given Participant will receive, and to which their number of ZND Loyalty Points will be subject, in accordance with the Regulations described in § 4(2) of the Regulations.  Each of the individual Contest Tasks can be completed a specific number of times, in accordance with the Regulations described in Table A below:

Referring new users helps you earn points through a commission of:

  1. 3% of the Points earned by referrals  at level 1 (directly from the Participant's link);

  2. 1% of Points earned by referrals at level 2 (by persons to whom the persons described in point a. above made the Referral);

Any number

  1. Ranking Points - i.e. points that will constitute the final result entitling Participants to obtain a specific place in the Winners' Ranking and receive a specific Prize as part of it, in accordance with § 6 below, will be calculated as follows:

  1. Points obtained as part of the Contest Task described in § 4(1)(A) above (ZND Loyalty Points) will be determined on the basis of the sum of points for individual Activities within the ZND Loyalty Program, obtained exclusively during the duration of the Contest (resulting from § 3(1) above);

  2. Points obtained as part of the Contest Task described in § 4(1)(B) above will be determined on the basis of the result obtained by Participants in the Application during the Contest (resulting from § 3(1) above);

  3. Then, based on the number of points obtained in accordance with § 4(2)(b) above (as part of the Contest Task in the Application), the Organizer will award the Participants - on the terms specified in § 4(2)(d) below - according to the number of points obtained in this way, an appropriate multiplier (hereinafter referred to as the "Multiplier"), by which the total points obtained in accordance with § 4(2)(a) (ZND Loyalty Points) and § 4(2)(b) (Application Points) in order to determine the final number of Ranking Points entitling them to receive specific Prizes;

  4. the Regulations on the basis of which Participants will be assigned a given Multiplier are set out in the Appendix to these Regulations ("Table B", which is available here: https://zondacrypto.com/documents/d/guest/booster-rewards-06);

  5. it is stipulated that only those Participants who, as part of the ZND Loyalty Points, determined on the basis of the Regulations described in § 4(2)(a) above, and who, as part of the Application Points, determined on the basis of the Regulations described in § 4(2)(b) above, managed to accumulate 1,000 or more Application Points during the Contest period;

  6. the number of ZND Loyalty Points obtained before the start of the Contest as part of the Account on the ZND Platform will not be taken into account when determining the number of Ranking Points and meeting the requirement referred to in section 2(e) above;

  7. Therefore, the Ranking Points, on the basis of which the Ranking of Winners will be determined, will be calculated as the product of the sum of ZND Loyalty Points and Application Points accumulated during the Contest and the Multiplier obtained for the number of Application Points earned during the Contest, and therefore it will be done as follows (the numbers and data provided are examples only and are not binding in determining the final result of the Contest):

Formula: (ZND Loyalty Points + Application Points) x Multiplier = Ranking Points

Examples:

Participant X earned 15,000 points under the ZND Loyalty Program during the Contest and 10,000 points under the Application. According to the ranking of Application Points, he took (for example) 1st place, so his Loyalty Points were multiplied by a multiplier of x10 - and thus he obtained 250,000 Ranking Points.

Participant Y obtained 1,000 points under the ZND Loyalty Program during the Contest, 500 points under the Application Points, and took 10th place in the Application tasks. However, he did not meet the requirement specified in § 4(2)(e) and was therefore not qualified for the Winners' Ranking, and his points could not be multiplied by the multiplier.

Participant Z obtained 30,000 points under the ZND Loyalty Program during the Contest and 10,000 points under the Application Points. According to the ranking of points in the Application, he took (for example) 7th place, so his Loyalty Points were multiplied by a multiplier of x8 - and thus he obtained 320,000 Ranking Points.

§ 5

Contest rules

  1. The correct completion of the Contest Task is considered to be the completion of both Contest Tasks described in § 4(1)(A) and (B) of the Regulations, in accordance with the Regulations set out in this paragraph, and the fulfillment of all Contest requirements specified in § 4 and § 2.

  2. The Contest is open, i.e. anyone who meets the requirements specified in the Regulations may participate.

  3. The Contest Task may be completed during the Contest, within the time specified in § 3(1) of the Regulations, but only until its official end. Completion of the Contest Task after the time referred to above will not be taken into account by the Organizer.

  4. After the end of the Contest, all Participants who have completed the Contest Tasks (in whole or in part) specified in § 4 of the Regulations and have met all the requirements specified in the Regulations (hereinafter: "Winner") will receive a prize in the corresponding part, in accordance with § 6 of the Regulations (hereinafter: "Prize").

  5. When determining the Winners, the Contest Commission shall also decide on the awarding of a given Prize in the Contest to a given Winner, guided by the criteria described in the Regulations and verifying that the Winner has fulfilled the conditions set out in the Regulations. Failure to meet these conditions may result in the exclusion of such a Participant from the Contest and the awarding of the Prize to another Participant, as well as the forfeiture of the Prize in favor of the Organizer (in the absence of Participants meeting the conditions for the award of the Prize).

  6. Each Winner who, as part of the Contest, receives a Multiplier related to the performance of the Contest Tasks described in § 4(1)(B) (Table A), is also required to provide their email address in the Application, which must match the email address used on the Platforms, in order to establish the Winner's identity and enable the Organizer to award them the Prize. Failure to meet this requirement will result in the Prize being awarded to another Winner, which is reserved as a right and not an obligation of the Organizer.

  7. The Organizer reserves the right to exclude from participation in the Contest or deprive of the right to the Prize, even after the end of the Contest - Participants whose actions violate the law, good manners, or the Regulations, in particular Participants who do not act personally but through third parties, and who use different accounts on Platforms or Social Media to act on behalf of the same Participant.

  8. In order to clarify any doubts related to a Participant's activity in the Contest, the Organizer may contact the Participant using the means of communication used by the Participant. During such contact, the Organizer may expect the Participant to provide detailed information regarding their participation in the Contest.

  9. Once the Organizer has determined the information concerning the Winners of the Contest and verified that they meet the requirements of the Contest, the Prize will be awarded to them within the time limit and on the terms specified in § 3(3) and § 6 of these Regulations.

  10. Information about the Winners of the Contest will be presented in the Winners Ranking published on Social Media on the date specified in § 3(2) of the Regulations (hereinafter referred to as the "Winners Ranking"), after calculating all the Ranking Points of the Participants, in accordance with § 4(2) of the Regulations, and after the Commission has assessed whether all Participants have met the criteria specified in § 4 and § 2 of the Regulations, entitling them to receive the Prize.

  11. The number of Winners in the Winners Ranking will depend on the number of Participants who correctly met the criterion specified in § 4(2)(e) , i.e. only those Participants who, at the end of the Contest, have at least 1,000 ZND Loyalty Points earned during the Contest and at least 1,000 Application Points will be included in the Winners Ranking.

  12. At the same time, during the Contest, the Organizer will publish information on social media, in the form of a partially anonymized Ranking, on a weekly basis, about how many ZND Loyalty Points the Participants have accumulated so far as part of the Contest. This information will only include data on ZND Loyalty Points collected as part of the Contest, and therefore will not include data on ZND Loyalty Points collected outside the Contest or Application Points. Information on how many Points a Participant has collected from the Application will be available to the Participant in their Application account.

§ 6

Prizes

  1. The prizes in the Contest are ZND Tokens (hereinafter also referred to as "ZND Tokens"), which, as part of the Contest pool totaling 100,000 ZND Tokens to be distributed among all Winners, will be assigned in the appropriate amount, following the Regulations described in this paragraph, to the Winners' wallets on the ZND Platform.

  2. The Prize Pool, specified in § 6(1) above, i.e. ZND Tokens, will be distributed among all Winners included in the Winners' Ranking in accordance with the Regulations described in § 4 and § 5 of the Regulations, i.e. those who - by completing the Contest Tasks - have accumulated at least 1,000 ZND Loyalty Points and 1,000 Application Points as part of the Contest and meet the other Participation criteria described in § 2 and § 4 of the Regulations. ZND Tokens will be allocated to the Winners in an amount corresponding to their place in the Winners' Ranking (the first place in the Ranking will receive the most ZND Tokens, the subsequent places - relatively fewer).  In view of the above, the Organizer is unable to determine the amount of the Prizes for individual places in the Winners' Ranking before the end of the Contest, and such amount will depend on the number of Participants included in the final Winners' Ranking.

  3. ZND Tokens will be awarded to Winners at the time of the Contest's conclusion in the form of mZND points and assigned to the Winners' wallets on the ZND Platform, and then exchanged by the Organizer for ZND Tokens. The exchange of mZND Points for ZND Tokens will take place gradually within 60 days from the date specified in § 3(3) of the Regulations. The mZND Points of a given Winner will be secured by assigning them to their wallet on the ZND Platform.

  4. The Organizer reserves the exclusive right to determine the number of ZND Tokens (and mZND points, respectively) allocated to each Winner, taking into account their distribution among all Winners included in the Winners' Ranking, in relation to their positions in this Ranking, i.e., the higher in the Ranking, the greater the number of ZND Tokens assigned to a given Winner.

  5. The Organizer informs that the condition for awarding the Prizes is to have, on the date of the said award, a fully verified Participant's account on the Platforms (ZND and zondacrypto, respectively), participation in the ZND Loyalty Program, and compliance of their actions with the Regulations.

  6. The Organizer does not provide any guarantee regarding the value of the ZND Token.

  7. Receiving Prizes in the Contest does not require Participants to make any purchase or payment for the Prizes awarded to them, including ZND Tokens. The Organizer does not charge any fees and/or commissions for assigning ZND Loyalty Points or ZND Tokens to the Participant's wallet. The above applies only to the one-time awarding of ZND Loyalty Points and ZND Tokens to the Participant as part of the Contest and does not apply to subsequent independent actions of the Participant on their account, including those related to the ZND Token.

  8. The Organizer reserves the right to change the number of Prizes in favor of the Winners (by awarding additional prizes).

  9. The Winner may be required to provide the Organizer with a private message containing all data required by the Organizer and necessary to determine the ownership of accounts on the Platforms, in accordance with § 2 of these Regulations in order to correctly assign the Prize to the Winner, as well as other data necessary to determine the Winner's correct participation in the Contest.

  10. If the above information obligations are not fulfilled within the time limit specified by the Organizer, the Winner may lose the right to the Prize. In such a case, the Organizer reserves the right to award the Prize to another Participant selected by the Contest Commission.

  11. It is not possible to transfer the right to the Prize to third parties. It is not possible to pay the equivalent of the Prize in any FIAT currency or other cryptocurrency.

  12. It is possible to waive the Prize by submitting a relevant statement to the Organizer at the e-mail address [email protected]. If the Winner waives the Prize, the Organizer reserves the right to award the Prize to another Participant.

§ 7

Organizer's liability

  1. The Organizer shall not be liable for the inability to deliver the Prize to the Winner and fulfill the Prize for reasons beyond the Organizer's control, including in connection with the provision of incorrect contact details, as well as in connection with events of force majeure. In such a case, the Winner will be informed of the above circumstances in a private message or will be asked to contact the Organizer by e-mail.

  2. The Organizer shall not be liable for random events preventing Participants from taking part in the Contest.

  3. The Organizer shall not be liable for the Participants' inability to achieve the expected results of transactions on the Platforms for reasons attributable to the Participants.

  4. The Organizer shall not be liable for the inability to participate in the Contest for reasons beyond the Organizer's control.

  5. The Organizer does not provide any advice, recommendations, analyses, or suggestions regarding investing on the Platforms. The Organizer is not a broker, intermediary, agent, or advisor to the Participant and has no fiduciary relationship or obligations to the Participant in connection with the Participant's entry into the Contest or other activities performed by the Participant on the Platforms in this regard.  The Organizer does not recommend buying, selling, or holding any cryptocurrencies and informs that investing in cryptocurrencies involves a high degree of risk. There is a risk of losing the invested funds due to changes in cryptocurrency exchange rates.

  6. Any marketing material related to the Contest concerning crypto assets has not been reviewed or approved by any competent authority in any Member State of the European Union. The sole responsibility for the content of marketing material concerning crypto assets lies with the crypto asset provider.
