TERMS AND CONDITIONS OF THE CHARITY COLLECTION
ZONDACRYPTO - FUNDS FOR FLOOD VICTIMS
§1
These Terms and Conditions (hereinafter: Terms and Conditions) of the Charity Collection "zondacrypto - Funds for Flood Victims", sets out the rules of the Collection organized by BB Trade Estonia OÜ with its registered office in Harju maakond, Tallinn, Lasnamäe linnaosa, Tähesaju tee 9, 1391 Estonia, registered in the Register of Entrepreneurs under the number 14814864, which is the operator of the zondacrypto platform, with the support of the zondacrypto Foundation (Fundacja zondacrypto), registered in Poland, in the Register of Associations, Other Social and Professional Organizations, Foundations and Independent Public Health Care Institutions under the number 0001103797.
The Terms and Conditions set forth the rules of the Collection carried out by zondacrypto through the tools provided by zondacrypto and apply to all relations between zondacrypto and Supporters in the course of the Collection.
It is the responsibility of zondacrypto to supervise, on an ongoing basis, that there is no risk of conflicts of interest between zondacrypto, the Supporters and the Beneficiary in connection with the course of the Collection, as well as to ensure the proper conduct of the Collection and its compliance with applicable laws.
§2
Specific expressions contained in the Regulations have the following meanings:
zondacrypto - BB Trade Estonia OÜ with its registered office in Harju maakond, Tallinn, Lasnamäe linnaosa, Tähesaju tee 9, 1391 Estonia, entered in the register of entrepreneurs under the number 14814864, being the operator of the zondacrypto platform;
Beneficiary - Polski Czerwony Krzyż with its registered office in Warsaw at Mokotowska 14, 00-561 Warsaw, operating on the basis of the Act of November 16, 1964 on the Polish Red Cross (Journal of Laws No. 41, item 276, as amended) and the Statute of the Polish Red Cross approved by the Regulation of the Council of Ministers of September 20 2011 (Journal of Laws No. 217, item 1284), entered into the Register of Associations, Other Social and Professional Organizations, Foundations and Independent Public Health Care Institutions of the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw, XII Commercial Division of the National Court Register, under KRS number 0000225587 as a Public Benefit Organization, NIP: 5260250481, REGON: 007023731;
Collection - this collection organized by zondacrypto under the Terms and Conditions;
Supporter - a natural person with full legal capacity, a legal person and an organizational unit without legal personality, to which the law grants legal capacity, which intends to participate or has participated in the Collection, subject to the content of § 5 point 1 of the Terms and Conditions;
Contribution - funds in cryptocurrencies paid to support the Collection;
Funds - the total funds accumulated in cryptocurrencies thanks to Contributions provided by Supporters in the Collection;
§3
The Collection is organized to support the Beneficiary's statutory objectives implemented in connection with the #NaRatunekFlood aid campaign addressed to people affected by floods and flood threats that occurred in September 2024 in the Lower Silesian, Opole and Silesian Voivodeships, Poland. Detailed activities of the Beneficiary carried out as part of the #NaRatunekPowódz aid campaign are described on its website at: https://pck.pl/naratunekwodziz/.
The Collection is carried out in unlimited territory taking into account the reach of the Internet network.
The Collection takes place from: 10:00 CET on September 18, 2024 until 24:00 CET on October 1, 2024.
§4
The Collection will consist of zondacrypto collecting Funds, on specially dedicated zondacrypto Contribution addresses, in the form of the following cryptocurrencies:
BTC,
ETH,
XRP,
TRX,
SUN,
USDT,
USDC,
THERE IS,
LTC,
DOT.
The condition to participate in the Collection is to make a Contribution via a dedicated Contribution form available to Supporters after logging into their account on zondacrypto platform on the web or mobile application.
Funds donated by the Supporter to the Collection cannot be withdrawn.
By making a Contribution as part of the Collection, the Contributor accepts these Terms and Conditions as well as zondacrypto's “Terms and Conditions of Service” and “Privacy Policy” available at https://zondacrypto.com/en/legal/zondacrypto-exchange.
The making of a Contribution by a Supporter and the related sharing of personal data is entirely voluntary, based on consent - in accordance with § 8 point 2 a) of these Terms and Conditions.
§5
Only a person who is a verified zondacrypto customer, i.e., at the time of making a Contribution, has an account on the zondacrypto platform and has passed the required identity verification (KYC) in its entirety (with respect to all verification steps) in accordance with the “Terms and Conditions of Service” available at https://zondacrypto.com/en/legal/zondacrypto-exchange, can become a Supporter.
Any Contribution to the Collection made by a person who does not meet the requirement referred to in point 1 above shall be refunded by zondacrypto to such person to the address from which the Contribution was made within a reasonable time, taking into account zondacrypto's current capabilities, days and working hours of zondacrypto employees.
§6
All of the Funds raised in the Collection will be allocated to the purpose of the Collection as specified in § 3 point 1 of the Terms and Conditions.
Immediately, but no later than within 14 business days after the end of the Collection, zondacrypto undertakes to convert the collected Funds into PLN currency free of charge, and in turn to transfer the Funds in this form to the bank account indicated by the Beneficiary.
§7
Complaints related to participation in the Collection and the conduct of the Collection, may be submitted electronically via the contact form available at: https://zondacrypto.com/en/helpdesk/contact-page or by letter, in the form of a registered letter sent to zondacrypto's address.
Complaints should be submitted immediately after the occurrence of the objectionable event, but no later than within 7 days from the date of completion of the Collection (in the case of complaints sent by registered mail, the postmark date is decisive).
The complaint should contain all the information specified in the zondacrypto's “Terms and Conditions of Service” located on the zondacrypto platform, available at https://zondacrypto.com/pl/legal/zonda-exchange.
The complaint procedure is carried out in accordance with the procedure contained in the regulations indicated in point 3 of this section.
§8
The controller of the personal data is BB Trade Estonia OÜ with its registered office in Harju maakond, Tallinn, Lasnamäe linnaosa, Tähesaju tee 9, 1391 Estonia (office number 10), a company under Estonian law, registered in the Register of Entrepreneurs under number: 14814864 (hereinafter: Controller).
The Controller processes personal data on the basis of:
Article 6(1)(a) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter: GDPR) - consent of the data subject,
Article 6(1)(b) of the GDPR - processing is necessary for the performance of a contract
Article 6(1)(c) of the GDPR - in order to fulfill a legal obligation incumbent on the Controller, i.e. to keep accounting documents,
Article 6(1)(f) of the GDPR - the Controller’s legitimate interests consisting, in particular, in conducting the Collection, responding to possible complaints, establishing, investigating or defending against possible claims.
Any personal data obtained by the Controller in connection with the implementation of the Collection will be deleted or anonymized within 60 days, counting from the date of completion of the Collection - with the exception of data that will be necessary for the fulfillment of legal obligations incumbent on the Controller and in order to fulfill the Controller's legitimate interest - necessary for the processing of complaints or other form of claims, as well as for the purposes of possible judicial or administrative proceedings.
Personal data obtained as a result of the Collection are protected by technical and organizational measures to ensure an adequate level of protection, in accordance with applicable regulations.
Data recipients may be entities processing personal data on behalf of the Administrator in connection with the services provided to the Controller, e.g. financial and accounting, advisory, auditing and IT services.
Personal data obtained as a result of the Collection is not subject to automated decision-making for the purposes of the Collection.
Persons whose personal data is processed in connection with the Collection have the right to:
demand from the Controller access to, rectification, erasure or restriction of processing of personal data concerning the data subject, and the right to object to processing, as well as the right to data portability;
file a complaint with the supervisory authority, the Estonian Data Protection Inspectorate, 39 Tatari, 10134 Tallinn, Estonia, if they believe their personal data is being processed unlawfully;
All requests, questions and demands related to the processing of personal data should be addressed to the Data Protection Officer designated by the Controller: [email protected].
§9
These Terms and Conditions are the only document defining the detailed rules of the Collection.
The Terms and Conditions are available for the duration of the Collection on the zondacrypto website and at the zondacrypto headquarters.
All information about the Collection can be obtained by contacting zondacrypto at e-mail: [email protected].
In the event of a conflict between the provisions of these Terms and Conditions and the “Terms and Conditions of Service” of zondacrypto available at https://zondacrypto.com/en/legal/zondacrypto-exchange, the provisions of these Terms and Conditions shall apply.
The Terms and Conditions are effective as of September 18, 2024.
Zondacrypto has the right to refrain from carrying out the Collection, change its rules or date and end the Collection without giving reasons, provided that the Funds collected by then will be fully transferred to the purpose referred to in §3 section. 1 of these Terms and Conditions.
