Regulations of the Contest "#ZondoloOnTour - First Game!"

 

§ 1 General provisions

 

1. These regulations (hereinafter: "Regulations") define the rules of the "#ZondoloOnTour - First Game!" contest. (hereinafter: "Contest").

 

2. The organizer of the Contest is BB Trade Estonia OÜ, headquartered in Tallinn, address: Harju maakond, Tallinn, Lasnamäe linnaosa, Tähesaju tee 9, 1391 Estonia (office No. 10), registered in the Register of Entrepreneurs under the number 14814864, (hereinafter: "Organizer") operating an online service (https://zondacrypto.com/) through which it provides services in the form of running a cryptocurrency exchange (hereinafter: "Platform").

 

3. The tasks of the Contest Organizer are to supervise the course of the Contest on an ongoing basis, including, in particular, whether there is a risk of a violation of the Contest rules established by these Regulations in connection with the course of the Contest. 

 

4. The Organizer also applies in these Contest Regulations definitions consistent with those contained in the regulations available at https://zondacrypto.com/en/legal/zonda-exchange, including in particular the zondacrypto Terms and Conditions of Service: https://zondacrypto.com/en/legal/zondacrypto-exchange/terms-and-conditions-of-service, to which it hereby refers in this regard.

 

5. The Contest is conducted in connection with a sports event in the form of a basketball match between the Dziki Warszawa vs Anwil Włocławek teams, which takes place on February 2, 2025 at 5:30 p.m. CEST at the Kolo Hall, 60 Obozowa Street, Warsaw, Poland (hereinafter referred to as the "Event"). 

 

6. The venue for the Contest is the Organizer's social media on the Instagram platform - the profile under the name "zondacrypto": https://www.instagram.com/zondacrypto/ (hereinafter: "Social Media"). Links to the Contest will also be made informatively available on zondacrypto's social media profiles, including: 

1. on Facebook: https://www.facebook.com/zondacryptopolska & https://www.facebook.com/profile.php?id=61563659978501 

2. on x.com (formerly: Twitter) https://x.com/zondacryptopl & https://x.com/zondacrypto & https://x.com/ZND_co

3. on Telegram: https://t.me/znd_official & https://t.me/zondacryptopolska & https://t.me/zondacryptoworld.

 

7. The Contest is directed to users of the above mentioned Social Media. The purpose of the Contest is to reward Participants for actively following the Organizer's Social Media and to engage Participants through active participation during the Contest Period.

 

8. The Organizer emphasizes that the Contest is not created, administered or sponsored by the aforementioned social media.

 

9. The Contest Organizer is the sole founder of the Contest Prize.

 

10. The Contest is not a cash lottery, a sweepstakes, a promotional lottery, or any other game of chance or betting.

 

§ 2 Participation in the Contest

 

1. The Contest is intended only for individuals - recipients of Social Media, who are adults (who are 18 years of age or older) and who have a residence in countries/regions supported by the zondacrypto cryptocurrency exchange operated by the Organizer (countries/regions not accepted are indicated on https://zondacrypto.com/en/nonacceptable-countries).

 

2. Only a natural person who has an active profile/account on the "Instagram" platform, in accordance with the rules of this platform, may become a participant in the Contest (hereinafter: "Participant").

 

3. The Contest can only be participated in personally, and therefore it is unacceptable to take part in the Contest on behalf of third parties. The Organizer reserves the right to verify the Participants of the Contest and, in the event of reasonable doubts regarding the fulfillment of the above mentioned conditions, to possibly deny the Participant winning the Contest on this basis. 

 

4. Only self-reported answers, the author of which is the applicant (Contest Participant), can be submitted to the Contest.

 

5. Employees, members of the authorities and representatives of the Organizer and other entities directly involved in preparing and conducting the Competition, as well as persons cooperating with the above-mentioned entities on a permanent basis on a basis other than an employment relationship, and members of their immediate families, i.e. ascendants, descendants, siblings, spouses, parents of spouses and persons in an adoption relationship with them, cannot participate in the Competition.

 

6. The condition to participate in the Contest is accepting the content of these Regulations and expressing the desire to participate in the Contest by making a Contest entry in the form of fulfilling all Contest requirements together on the aforementioned Organizer's Social Media profiles. 

 

7. The Participant who enters the Contest in accordance with the preceding paragraphs is obliged to familiarize himself with the provisions of the Regulations. Entering the Contest is tantamount to acceptance of the content of these Regulations.

 

8. Entering the Contest is completely voluntary and free of charge. 

 

9. Participation in the Contest and the related provision of personal data is completely voluntary, based on the Participant's consent - in accordance with § 9. point 2. letter a) of these Regulations. 

 

10. In the event of winning the Prize referred to in § 5. below, the Participant further agrees to publish his/her name or the name of the profile used in social media, as part of the post/announcement created by the Organizer regarding the end of the Contest and the selection of winners, on the Organizer's profiles in the aforementioned Social Media. 

 

§ 3 Duration of the Contest

 

1. The Contest shall commence on January 28, 2025 at the time of its announcement on the Organizer's Social Media and shall continue until January 30, 2025 at 11:59 p.m. CET (hereinafter: "Contest Duration").

 

2. Settlement of the Contest will take place the day after its conclusion, with the announcement of the Winners scheduled for January 31, 2025. 10:00 CET. The Winner of the Contest will be notified of winning on this date by the Organizer publishing the winning post (stories) on Social Media on the Organizer's profile.

 

3. The prize will be awarded to the Winner on the condition that the Winner contacts the Organizer in a private message on the profile on which the Contest is organized, and, in the situation provided for in § 5. point 3 of the Regulations, on the condition that the Winner indicates all data allowing the prize to be sent. In order for the prize to be awarded to the Winner, it is required for the Winner to contact the Organizer without delay within 10 hours from the publication of the story about the results of the Contest (but no later than the end of January 31, 2025), and then to provide, without delay, in a private message to the Organizer, all contact details, including, in the situation provided for in § 5. point 3 of the Regulations, the data for sending the prize indicated in § 5. point 4 of the Regulations.
    

4. Transfer of the prize, referred to in § 5. point  3 of the Regulations, to the Winners will be made at least one day before the official Event (the day of the match between Dziki Warszawa and Anwil Włocławek), by sending tickets to the Winner via e-mail.

 

§ 4 Rules of the Contest

 

1. The Contest Task consists in the Participant's fulfillment of the following Contest Tasks together (hereinafter: "Contest Tasks"):

1. observing on the platform "Instagram": Organizer's profile (https://www.instagram.com/zondacrypto/) and "Dziki Warszawa" profile (https://www.instagram.com/dzikiwarszawa/),

2. answering in a comment under the Contest Post the question "Why should you be the one to take part in our Contest during the game Dziki Warszawa - Anwil Włocławek?". Only the answer posted under the Contest Post placed on the Organizer's Profile on "Instagram" platform: (https://www.instagram.com/zondacrypto/) will be taken into account when choosing the Winners.

 

2. The Contest is open to the public.

 

3. Completion of the Contest Tasks may take place from the moment of announcement of the Contest indicated in § 3.1 of the Regulations, however, only until 11:59 p.m. CEST on the day of termination of the Contest, i.e. January 30, 2025. Completion of any of the Contest Tasks after the expiration of the Contest Period, indicated in § 3.1 above, will result in such Contest entry being disregarded by the Organizer.

 

4. The correct answer is considered to be providing an answer to the contest question (indicated in § 4. para. 1. b. of the Regulations) and doing it only under the contest post on the Organizer's profile on "Instagram", fulfilling all contest requirements, indicated in § 2 of the Regulations, and completing all tasks indicated in § 4. para. 1 of the Regulations together (hereinafter: "Contest Answer"). The Participant's completion of only some of the tasks or posting the Contest Answer under the Contest post on a profile other than the Organizer's Profile specified in § 4. para. 1. b. of the Regulations. Regulations, will entail that the Organizer will consider the provided answer as incorrect or incomplete. 

 

5. The Contest responses will be evaluated by the Contest Commission (hereinafter referred to as the "Commission"), consisting of representatives of the Organizer and persons designated by the Organizer, as specified in § 7. of the Regulations. 

 

6. At the end of the Contest, the Commission will select from among the Participants two (2) winners who have collectively completed all the Contest Tasks specified in § 4. point 1 of the Regulations, and whose answers to the Contest question are considered by the Commission to be the best (hereinafter referred to as: "Winners", and individually as: "Winner"). 

 

7. In the Contest, prizes will be awarded to the Winners as described in § 5 of the Regulations. The prizes are equal and of identical value, regardless of the order in which they are awarded and the order in which the Winners are designated.

 

8. The Commission will award, taking into account all correct Contest answers, two persons, based on the evaluation of all Contest answers that meet the conditions of these Regulations, taking into account such criteria as: creativity and originality of the answer, consistency and accuracy of the answer, clarity and precision of the statement, innovation of the idea and the ability to stand out from other participants.
    

9. The answers of the Participants who, in the opinion of the Contest Commission, provided the most interesting and creative answers to the Contest question (winning answers) will win. The decision in this regard will rest solely with the Contest Commission considering the given entries.  

 

10. When selecting the Winners, the Commission shall at the same time decide on the award of a given Prize in the Contest to a given Winner, following the criteria indicated in the preceding sentence and assessing whether he/she meets the conditions set forth in § 2. and § 4. of the Regulations. 

 

11. The winner of the Contest will be announced by posting the winning post (stories) on the Organizer's social media mentioned above, indicating the name or username/login of the Participant who provided the correct answer. When announcing the results, the Organizer will ask the Winner to contact him/her in a private message within the social network where the announcement of the Contest results was posted. Once contact is made, the Organizer will provide further instructions in order to determine all the data necessary to transfer the Prize to the Winner and to enable the Winner to properly use the Prize. 

 

12. The Winner is obliged to make immediate contact with the Organizer in a private message on the social media on which the announcement of the results of the Contest was posted, within 10 hours from the announcement of the results of the Contest, but no later than the end of January 31, 2025, under pain of complete forfeiture of the right to the Prize. Failure to contact the Organizer within this timeframe will be equivalent to the possibility of selecting another Winner, while this is reserved as a right and not an obligation of the Organizer (due to organizational capabilities, it may not be possible to provide another Winner with participation in the Prize at a later date). 

 

13. The Organizer reserves the right to exclude from participation in the Contest or deprive of the right to the Prize Participants whose actions are contrary to the law, good morals or the Regulations, in particular Participants who:

1. do not act personally, but through third parties;

2. use different accounts on the Organizer's platform to act on behalf of/apply for the same Participant;

3. if third-party claims have been filed against their Contest Answer.

 

14. In order to clarify any doubts related to the Participant's activity in the Contest, the Organizer may contact the Participant using the means of communication provided by the Participant; during such contact, the Organizer may expect the Participant to provide detailed information regarding his/her participation in the Contest.

 

15. Participant, applying for participation in the Contest, declares that the Contest Answer submitted by him does not contain content that violates the law or is inconsistent with good morals, in particular does not violate the rights of third parties, does not incite violence, intolerance, does not contain vulgarities or advertising content of third parties.

 

§ 5 Award

 

1. As part of the Contest, each of the Winners (2 winners) will receive a Prize in the form of double tickets to the Event (according to the terms specified in § 5.3 below) and the opportunity to participate in the Organizer's exclusive competition held during the Event, at the intermission of the match. Participation in the competition during the Event is for the Winners only (not for their Accompanying Persons).
    

2. If the Winner does not have a ticket to the Event, the Organizer will grant the Winner a ticket to the Event (hereinafter referred to as: "Ticket" and in plural as "Tickets") in the number of 2 (in words: two) pieces, which also includes a Ticket for an Accompanying Person. If the Winner will already have his/her own ticket for the Event - he/she is entitled to receive one ticket for one Accompanying Person. However, it is impossible in such a case to transfer the Ticket intended for the Winner to another third party.
    

3. The Prize will be sent to the Winner as soon as it is received by the Organizer, but no later than the day before the day of the Event. The Prize will be forwarded to the Winner by email, to the Winner's email address, indicated by the Winner in the course of his/her private contact with the Organizer, in accordance with § 4. points 11 and 12 of the Regulations. 

 

4. The Winner, in order to be able to take advantage of the Prize indicated in points 1 and 2 above, is obliged to send all data necessary for the transfer of the Prize to the Organizer, i.e., in accordance with the Organizer's instructions, within the deadline specified above in a private message:

1. first and last name, 

2. date of birth,

3. PESEL, and in case it has not been assigned - type, series and number of identity document and date of birth,

4. e-mail,

5. telephone number.

The Winner may refuse to provide the aforementioned data. Failure to provide the required information within the specified time, however, may result in forfeiture of the right to claim the Prize.

 

5. In the event that the Winner's Prize is a double ticket, as referred to in § 5. points 1 and 2 of the Regulations, the Winner has the right to freely choose an Accompanying Person to enjoy the double ticket together with the Winner (hereinafter: "Accompanying Person") - provided that the requirements set forth below are met.

 

6. The Accompanying Person must be a person of legal age (who is 18 years of age or older). 

 

7. The Winner, in order to be eligible for the Prize in the form of a double ticket referred to in § 5.1 and § 5.2 of the Regulations, is obliged to send in a private message to the Organizer, as indicated by the Organizer, the data of the Accompanying Person necessary for the transfer of the Prize to him/her, i.e..:

   1. Name and surname of the Accompanying Person Person,

   2. PESEL of the Accompanying Person, and in case it has not been assigned - type, series and number of the document confirming the identity of the Accompanying Person and date of birth. 

If the above information obligation is not fulfilled within the timeframe specified above, the Winner will lose the right to choose an Accompanying Person. 

 

8. The Organizer reserves the right to verify the Accompanying Person and the compliance of the data provided by the Winner, and in case of reasonable doubts about the fulfillment of the aforementioned conditions - to possibly deny the Winner the right to choose the Accompanying Person.

 

9. The Organizer stipulates that the number of Prizes may be changed in favor of the Winners (by awarding additional prizes).

 

10. The Commission independently awards the Prizes to the Winners guided by its own discretion and the criteria specified in § 4. points 8 and 9 of the Regulations.

 

11. One Winner of the Contest is entitled to only one Prize. 

 

12. The Organizer shall not cover any additional costs related to the collection and use of the Prizes, in particular those related to the participation in the Event, such as the costs of travel, passage, cabs, flights, shipping, accommodation, meals and other incidental costs. Such costs shall be borne solely by the Winner in full and the Winner shall not be entitled to any reimbursement or compensation from the Organizer in this regard. 

 

13. It is not possible to transfer the right to the Prize to third parties.

 

14. Prizes are not exchangeable for cash equivalent or other services that are included in the Organizer's offerings

 

15. It is possible to resign from the Prize. In the case of the Winner's resignation from the Prize, the Organizer reserves the right to award the Prize to the next Participant designated by the Commission or forfeit the Prize to the Organizer (if it is not possible to award it to another Participant due to too short a time to the Event).

 

16. The Winner, as part of his/her use of the Prize, may be asked by the Organizer to prepare promotional materials regarding his/her participation in the aforementioned Contest (hereinafter: "Winner's Marketing Materials"). In such a case, the Winner may agree to publish the promotional materials prepared by him/her on the Organizer's social media, thereby granting the Organizer a free and unlimited license to publish them as part of the promotion of such social media of the Organizer, and solely for this purpose.  

 

§ 6 Liability of the Organizer

 

1. The Organizer is not responsible for the inability to realize the Prize of the Winner and to realize the Prize for reasons beyond the Organizer's control, including in connection with the provision of incorrect contact information, as well as in connection with force majeure events. In such a case, the Winner will be informed of the aforementioned circumstances in a private message or will be asked to contact us in a comment under the Contest Post. 

 

2. The Organizer is not responsible for any fortuitous events that prevent Participants from taking part in the Contest.

 

3. The Organizer is not responsible for the inability to claim the Prize if the Participant fails to meet the deadline specified in § 4.12 of the Regulations or provides incorrect data (his/her and/or Accompanying Person's) entitling him/her to claim the Prize.

 

4. The participant is solely responsible for the content of the Contest Answer provided, transmitted to the Organizer on social media, and in this respect releases the Organizer from any liability to third parties whose rights have been violated by publishing the solution to the Contest Task on its portals or by using the solution in a manner inconsistent with these Regulations.

 

5. The Organizer is not responsible for the claims of the Winner, as well as the Accompanying Person, related to the expectations of the organization of the Event. In the case of claims related to the organization of the Event, the Winner is entitled to file complaints on his/her own behalf directly to the entities responsible for such Event

 

6. The Organizer, within the framework of the Prize indicated in § 5. points 1-2, provides the Winner only with the participation in the Event and the opportunity to take part in a separate competition organized during the Event. Such participation in a competition during the Event is not equivalent to the awarding of any additional prize on this account. The rules of such a competition during the Event will be indicated in separate regulations applicable to such competition. The Organizer shall not be liable for the Winner's failure to win or any other expectation of the Winner in connection with the opportunity to participate in such a separate competition during the Event. 

 

7. The Winner, as well as the Accompanying Person, while participating in the Event, is obliged to behave culturally and in accordance with the rules of the Kolo Hall, according to the conditions in the audience area, and to comply with the provisions of the Rules of the Kolo Hall in Warsaw. In the event of any violation of the above, the Organizer reserves the right to immediately refuse further participation of the Winner, as well as the Accompanying Person, in the Event. 

 

8. The Organizer shall not be liable in any way to the Winner, as well as to the Accompanying Person, for the Winner's inability to use the Prize (e.g., to participate in the Event) as a result of the Winner's violation of the rules indicated in point 7 above or other circumstances for which the Organizer is not responsible. 

 

§ 7 The Contest Commission

 

1. The proper conduct of the Contest will be supervised by a Commission appointed by the Organizer, consisting of two persons.

 

2. The tasks of the Commission referred to in the preceding paragraph include, in particular:

1. Checking whether a given Participant meets all the conditions for participation in the Contest,

2. evaluation of the Contest Answers,

3. Determination of the Winners of the Contest,

4. Processing of Participant's complaints, in accordance with § 8. of the Regulations. 

 

§ 8 Complaints

 

1. Complaints related to participation in the Contest, the Participant may submit:

1. In writing, to: Harju maakond, Tallinn, Lasnamäe linnaosa, Tähesaju tee 9, 1391 ESTONIA (office no. 10, 2nd floor), or

2. electronically through the form available at: https://zondacrypto.com/pl/helpdesk/formularz-kontaktowy or by email to: [email protected].

 

2. Complaints should be submitted immediately after the occurrence of an event that raises concerns of a Participant participating in the Contest, but no later than within 7 days from the end of the Contest (for complaints sent by registered mail, the postmark date is decisive).

 

3. The complaint should contain all the information specified in the regulations found on the zondacrypto platform, available at https://zondacrypto.com/en/legal/zondacrypto-exchange, including the Terms and Conditions of Service - § 18.3.

 

4. The complaint procedure is carried out in accordance with the procedure contained in the regulations indicated in point 3 of this section, including the Terms and Conditions of Service - § 18(4) et seq. 

 

5. Complaints will be considered by the Contest Commission appointed by the Organizer, in accordance with § 7 point 2 of these Regulations.

 

§ 9 Personal Data 

 

1. The controller of the personal data is BB Trade Estonia OÜ with its registered office in Harju maakond, Tallinn, Lasnamäe linnaosa, Tähesaju tee 9, 1391 Estonia (office number 10), a company under Estonian law, registered in the Register of Entrepreneurs under number: 14814864 (hereinafter: "Data Controller").

 

2. The Data Controller processes personal data of Participants, Contest Winners and Accompanying Persons on the basis of: 

1. consent within the meaning of Article 6(1)(a) of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter: "GDPR");

2. Fulfillment of a legal obligation incumbent on the Data Controller within the meaning of Article 6(1)(c) of the GDPR to fulfill the obligation to keep accounting documents;

3. legitimate interest of the Data Controller in accordance with Article 6(1)(f) of the GDPR, consisting, in particular, in responding to possible complaints, claims made as a result of this Contest.

 

3. All data acquired by the Organizer on the Participants, Contest Winners and Accompanying Persons will be deleted or anonymized within 60 days, counting from the date of the end of the Contest or sending the Prize to the Contest Winner. 

 

4. Data of Participants, Contest Winners and Accompanying Person Persons will be deleted or anonymized in accordance with the preceding paragraph - with the exception of data that will be necessary for the purpose of fulfilling the legal obligations of the Data Controller and for the purpose of fulfilling the Data Controller's legitimate interest - necessary for the consideration of complaints or other form of claims submitted by Customers, Participants, Contest Winners or Accompanying Person Persons, as well as for the purpose of possible judicial or administrative proceedings.

 

5. The data is protected by technical and organizational measures to ensure an adequate level of protection, in accordance with applicable regulations.

 

6. The Data Controller processes only the personal data provided by the Participant or Winner of the Contest. The personal data of the Participants/Winners of the Contest/Accompanying Person are not subject to automated decision-making for the purpose of the Contest. 

 

7. For the purposes of realization of the Contest, personal data will be shared with companies affiliated by capital and personal relations with the Data Controller, i.e. - Orion Software sp. z o. o. and Expofer Servis House s. r. o., as well as - in connection with the necessity of transferring the Prize in the form of Tickets for participation in the Event - to the organizers of the Event, only to the necessary extent, necessary for the transfer of Tickets to the Winners and Accompanying Persons.

 

8. Participants in the Contest are entitled to:

1. to request from the Data Controller access to, rectification, erasure or restriction of processing of personal data concerning the data subject, and the right to object to processing, as well as the right to data portability;

2. file a complaint with the supervisory authority - Estonian Data Protection Inspectorate, 39 Tatari, 10134 Tallinn, Estonia, if the Participant believes that his/her personal data is being processed unlawfully. 

 

9. All requests, questions and demands related to Data processing should be addressed to the Data Protection Officer appointed by the Controller: [email protected].

 

§ 10 Intellectual property rights

 

1. By taking part in the Contest, the Entrant simultaneously declares that he/she is the sole creator of the Contest Answer and that he/she has full personal and property copyrights to the Contest Answer. The Participant further declares that the Contest Answer he/she provides does not violate the rights of third parties, including copyrights, related rights, image rights or other intellectual property rights.
    

2. As soon as the Winner of the Contest is announced, the Winner transfers to the Contest Organizer all copyrights to the answer provided, in all fields of exploitation, including in particular: 

1. The right to record and reproduce responses in any form, 

2. The right to publish, distribute and use the answers in materials promoting the Contest and the organizer's activities, including websites, social media, printed materials, etc. 

 

3. The winner declares that the Contest answer provided is not encumbered by any third party claims, and the Organizer shall not be liable for any third party claims related to the use of the answer in the Contest. 

 

4. The winner agrees that his/her submitted contest answer may be used free of charge in accordance with the above provisions, without payment of compensation. 

 

§ 11 Final Provisions

 

1. These Regulations are the only document setting out the detailed rules of the Contest.

 

2. The Organizer is entitled to change the content of these Regulations, both in part and in whole, at any time for reasons beyond the Organizer's control, as well as when such change is made exclusively for the benefit of the Participants (including by adding additional prizes, extending the duration of the contest and the possibility of answering the contest question, facilitating the Participants' access to participate in the contest and the possibility of obtaining a prize). Participants will be informed of any planned changes to the Rules through an adequate communication channel, such as Social Media.
    

3. Any changes to these Regulations will be effective from the moment they are published on the Organizer's website. 

 

4. If the participant does not accept the changes to the Regulations, he/she should withdraw from participation in the Contest.

 

5. Entering the Contest after the Rules have been amended shall be deemed acceptance of the new Rules.

 

6. The Regulations are available for the duration of the Contest on the Organizer's website (zondacrypto.com) and at the Organizer's headquarters.

 

7. Any doubts regarding the terms, conditions and deadline of the Contest, the provisions of its Regulations and its interpretation shall be resolved by the Organizer. Such resolution of the Organizer does not deprive the complainant of the right to pursue claims under the rules of law.  

 

8. All information about the Contest can be obtained by contacting zondacrypto at email address: [email protected].

 

9. In matters not regulated by these Regulations, the provisions of the Organizer's Regulations and generally applicable laws shall apply.In case of conflict between the provisions of these Regulations and the provisions of the Organizer's Regulations, the provisions of these Regulations shall apply.
    

10. The competent court to resolve disputes shall be the competent court of general jurisdiction.
